Understanding Your Environmental Rights

At Aberdare Yetu, our mission is to preserve the precious Aberdare Ecosystem and advocate for the environmental rights guaranteed to all Kenyans. These rights, enshrined in Kenya’s Constitution, empower us to protect our natural heritage and ensure a sustainable future for generations to come.

Constitutional Rights to a Clean & Healthy Environment

Kenya’s Constitution provides robust protection for the environment through Article 42 and Article 69. Article 42 guarantees every person the right to a clean and healthy environment. This includes the right to have the environment protected for the benefit of present and future generations through legislative and other measures.

Article 69 further mandates the State to:

  1. Ensure Sustainable Development: It requires the State to ensure sustainable exploitation, utilization, management, and conservation of the environment and natural resources.
  2. Protect Biodiversity: It emphasizes the protection of genetic resources and biological diversity.
  3. Maintain Tree Cover: The Constitution mandates the State to work towards achieving and maintaining a tree cover of at least 10% of the land area.

Current Threats to the Aberdare Ecosystem

Despite these constitutional safeguards, the Aberdare Ecosystem faces significant threats. The Kenyan government’s plan to build a 52km road through the Aberdares risks over 255 acres of bamboo, forests, and wildlife corridors. This proposed road threatens to disrupt the delicate ecological balance, endangering rare species and jeopardizing water sources vital for millions of Kenyans.

The Legal Battle for Aberdare

In response to these threats, environmental conservation groups have taken decisive action by bringing the government to the Environment & Lands Court. These groups have secured two significant rulings that order the government to halt road construction until the case is heard and determined. This legal intervention underscores the importance of upholding constitutional rights to a clean and healthy environment.

Alternative Solutions

Aberdare Yetu advocates for the prioritization of the 33km Kariamu-Ndunyu Njeru route as an alternative to the proposed road. This route offers a viable solution that empowers local communities while safeguarding wildlife habitats. It minimizes environmental impact and aligns with sustainable development principles.

Upcoming Court Hearing

The next hearing in this critical case is scheduled for June 3rd. This presents a vital opportunity to further advocate for the protection of the Aberdares. We will continue to stand firm, championing the rights enshrined in our Constitution and advocating for sustainable solutions that honor our natural heritage.
